A May 11, 2006 article from The Associated Press reports that the manner in which states report minority test scores under the No Child Left Behind law is being reviewed to determine if any adjustments are needed. Currently, each state can determine the minimum size a racial group must be in order for test scores from that group to be reported. Some members of Congress are concerned that a few states might be setting their minimum group size too high and, consequently, excluding test scores for a significant number of minority students. The U.S. Department of Education has indicated that it welcomes the opportunity to respond to these concerns.
